Pike County man charged with disorderly conduct, resisting arrest and 2 counts of battery
Pike County Court brought 49 YO Edward Shay of Glenwood. Shay faced charges of Disorderly Conduct, Resisting arrest, and 2 counts of Battery in the 2nd Degree for the following:
On January 8th at approximately 12:37 pm Captain Retford received a dispatch to a domestic incident involving Edward Shay. Upon arriving on scene Captain Retford addressed 2 female subjects in the front yard about the nature of the incident but was interrupted by Shay who was on the front porch. Mr. Shay started speaking in a very agitated tone, stood up abruptly, and started towards the front door of his home stating he was going to get his “stuff”. Captain Retford knew Mr. Shay to have violent tendencies and did not want him entering his home thus losing sight of him for safety concerns. Captain Retford observed what he believed to be a large knife sheath on Shay’s right hip. As Captain Retford accessed the porch Mr. Shay took an aggressive fighting stance and balled up his fists. Captain Retford closed the distance to Shay to subdue him and while doing so Shay swung on Captain Retford. It was around this time that Chief Kinzler arrived on scene to see the pair fighting and deployed his taser on Mr. Shay in an attempt to regain control. While Shay and Captain Retford were on the ground Shay kicked Chief Kinzler in the chest. Upon the 2nd deployment of Chief Kinzler’s taser Shay quit actively fighting the officers. The knife was removed from Shay’s person and Shay was taken into custody.
Following the altercation Chief Kinzler had a sore chest and Captain Retford had a small hematoma on the back of his head from being struck by Shay.
In court on Monday Shay changed his plea from guilty to no contest and made a plea recommendation of a 6 year sentence with the Arkansas Department of Corrections. The maximum punishment for Battery in the 2nd Degree allows for 6 years served per count. Shay’s pre-trail hearing is scheduled for July 26th and trial date set for August 19th.
