Hempstead County Declares Outdoor Burning and Fireworks Ban Amid Dry Conditions
In response to a critical lack of rainfall and worsening drought conditions, Hempstead County officials have declared an emergency ban on all outdoor burning and the discharge of fireworks. This order, enacted by Hempstead County Judge Jerry T. Crane, will remain in effect until the situation improves.
The decision comes after the court determined that current conditions pose a significant hazard to life and property.
Under Arkansas law (A.C.A. 12-75-108), such local disaster emergencies can only be declared by the Chief Executive or their designee. The enforcement of this ban will be managed through the Hempstead County District Court, with citations issued by the Hempstead County Sheriff’s Office, the Arkansas Forestry Commission, or any certified officer.
Violators of the outdoor burning and fireworks ban will face serious consequences. Setting fire to or causing flammable materials to ignite in violation of this order is classified as a Class A misdemeanor, carrying potential legal repercussions under A.C.A. 5-38-310.
